Convicted D.C. Sniper Eligible for Resentencing in Montgomery County
The infamous D.C. Sniper case that shook the DMV region twenty years ago is back in the spotlight as Lee Boyd Malvo, one of the convicted snipers, is eligible for a resentencing in Montgomery County. The now 37-year-old Malvo, who is currently serving three life sentences without parole, is entitled to a new hearing to comply with a 2012 Supreme Court ruling regarding juvenile sentencing.
Malvo, along with his mentor John Allen Muhammad, committed a series of shootings across five states before being captured in Maryland in 2002. Malvo pleaded guilty to six slayings in Montgomery County and received six additional life sentences. Muhammad was executed in 2009.
Despite the resentencing opportunity, it is unlikely that Malvo will be released from custody anytime soon. The Virginia Parole Board recently denied his first application for parole, citing him as a “risk to the community” and recommending that he serve more of his sentence before being considered for parole.
The Maryland Court of Appeals has stated that Malvo would need to be granted parole in Virginia before serving his consecutive life sentences in Maryland. A date for the resentencing hearing in Montgomery County has not yet been set, but the case continues to move forward.
